Day 2 of the potential updates that come along with a Labour Government. 𝐄𝐧𝐝𝐢𝐧𝐠 “𝐨𝐧𝐞-𝐬𝐢𝐝𝐞𝐝 𝐟𝐥𝐞𝐱𝐢𝐛𝐢𝐥𝐢𝐭𝐲” - The Labour Government plan on banning zero hours contracts and ensuring everyone has the right to have a contract that reflects the number of hours they regularly work, based on a twelve-week reference period. 𝐅𝐚𝐦𝐢𝐥𝐲 𝐟𝐫𝐢𝐞𝐧𝐝𝐥𝐲 𝐫𝐢𝐠𝐡𝐭𝐬 - Making parental leave a day one right. Parental leave gives parents the right to take up to 18 weeks’ leave – at the rate of up to four weeks’ a year – for each child over the course of their childhood. Parental leave is unpaid. Labour’s plans include extending statutory maternity and paternity leave, introducing a right to bereavement leave and urgently reviewing the shared parental leave framework. Labour would also make it unlawful to dismiss a woman during pregnancy or within six months of her return to work, except in specified circumstances. They also plan to introduce paid family and carer's leave. 𝐑𝐢𝐠𝐡𝐭 𝐭𝐨 𝐬𝐰𝐢𝐭𝐜𝐡 𝐨𝐟𝐟 - Giving workers the right to disconnect from work outside of working hours and not be contacted by their employer. This would follow the lead of some European countries like Ireland and Belgium. 𝐆𝐞𝐧𝐮𝐢𝐧𝐞 𝐥𝐢𝐯𝐢𝐧𝐠 𝐰𝐚𝐠𝐞 - The Labour Government plans on making sure that the minimum wage is a real living wage that people can live on. To do this, they will change the Low Pay Commission's remit so that alongside median ages and economic conditions, the minimum wage will for the first time reflect the need for pay to take into account the cost of living. 𝐒𝐢𝐜𝐤 𝐩𝐚𝐲 - Removing the lower earnings limit on statutory sick pay. 𝐅𝐚𝐢𝐫 𝐭𝐢𝐩𝐬 - Strengthening the Law to ensure hospitality workers receive their tips in full and workers decide how tips are allocated. 📱💼 Lately, I've been getting a flood of questions from employers about Australia's new "Right to Disconnect" law. “Can I still contact my employees after hours?"   "What’s considered ‘reasonable’ contact?"   "Will this change how we do business?" In recent weeks, the Right to Disconnect has become a hot topic in workplace reforms, so let’s break it down! 🧩 This new law gives employees the right to disconnect from work outside their working hours unless there’s a reasonable need for contact. But what’s reasonable? It’s about striking a balance between what's fair and sensible. 🤔 So before you hit “send" at 10 PM, ask yourself… 1️⃣ Why are you contacting the employee? Is it truly urgent, or can it wait until the morning? 2️⃣ How are you reaching out? Wages going up ⬆⬆⬆ What do you need to know? For Award-Free Employees: 👉 The new minimum wage for award-free employees will be $915.90 per week (based on a 38-hour work week), equating to $24.10 per hour. For Award-Covered Employees: 👉 The new minimum wages for award-covered employees will increase by 3.75% Effective Date and Pay Periods 👉These changes take effect from the first full pay period on or after July 1, 2024. For example, if your pay period starts on July 1, the new rates will apply from that date. If your pay period is fortnightly and runs from Monday 8 July 2024, changes will not apply to your payroll until this (full) pay period. Do You Need to Increase Pay Rates? 👉If you are already paying rates above the new minimum wage, generally, your existing pay rates will absorb the 3.75% increase, and no changes are required. Enterprise Agreements 👉Enterprise agreements replace the modern awards and provide assurances that base rates of pay are not lower than the applicable rates in modern awards. 👉Any business with an Enterprise Agreement will need to conduct an annual audit to ensure they still comply with their legal obligations. Plumbers and electricians must respond to urgent domestic situations, mechanics are called out to get broken down vehicles and people out of danger, energy workers attend to power failures which can result in fatalities, medical staff save lives by remaining on call, police are relied upon to respond to urgent matters, almost every sector has some kind of risk that requires certain people to answer the call when needed. For these circumstances, Modern Awards or other industrial instruments already provide for payment terms and conditions – and no business can lawfully remunerate their people less than these minimum standards of pay. So, what then, is the Fair Work Commission going to possibly draft that won’t further encroach on workplace level job design when the Modern Award system already accounts for (anecdotally) 90% of the scenarios where after hours work or contact is required? #RighttoDisconnect
