Recently I had the outmost pleasure of presenting the case of R. v. Bykovets at a Moot Court competition. The issue that Supreme Court of Canada adjudicated on was whether Canadian citizens have reasonable expectation of privacy in their IP Addresses under s.8 of Charter of Rights and Freedoms. It was to be determined whether the law enforcement agencies require a judicial authorization prior to obtaining IP Address, from third party web sites, linked to an online criminal activity. The reasoning by Majority and Dissent was a great learning experience of how the legal frameworks apply to matters relating to internet technology in the broader social context and constitutional rights. 🚨 Big decision for privacy class actions by BC’s top court (and not just because it is 56-pages long 😂) The BC Court of Appeal just found that companies could be held liable for privacy torts for failing to adequately safeguard personal information from a cyber attack. For those following this topic, Ontario’s top court has repeatedly reached the opposite conclusion, which has dampened the viability of class action claims against the companies targeted by cyber attacks.
