The Reserve Bank of India (“RBI”) on April 16, 2024, released draft regulations providing guidelines for Payment Aggregators (“PA”) facilitating face-to-face or proximity payment transactions (“PA-P”). These transactions require the physical instrument used for payment, such as a card or mobile phone, to be present at the point of transaction. As per the circular, non-bank entities that provide PA-P services are required to inform the RBI within 60 (sixty) days of the circular of their intention to obtain authorization. Banking entities are not required to procure such authorization. The non-bank entities are required to apply for authorization by May 31, 2025. Entities have also been directed to comply with the Guidelines on Regulation of PA and Payment Gateways under the March 17, 2020, circular within a period of 3 months from the date of the present circular. Existing non-bank entities should have a minimum net worth of Rs. 15,00,00,000 (Rupees Fifteen Crores) at the time of applying for authorization and should maintain a net worth of Rs. 25,00,00,000 (Rupees Twenty-Five Crores) from March 31, 2028, onwards.
