#MSME Day The world celebrates June 27th as MSME Day to honor MSMEs' contributions to the global economy. MSMEs in India contribute 30% to the GDP and are the largest employers, with nearly 11 crore people employed, second only to agriculture. Over the last decade, the government has encouraged MSME's by simplifying compliances, introducing mandatory 45-day payment periods for buyers of services from MSMEs, and offering credit through guaranteed government schemes. While these initiatives are commendable, our ground-level experience has been mixed or mostly negative. Sharing some of it here and hope to learn from others experience in managing these 1. Payment Delays: The 45-day payment period is good, and most of our clients adhere to it. However, there are loopholes we have encountered. One such exploit is when a buyer asks you to cancel the existing invoice a week or days before the end of the 45-day period, citing frivolous reasons, and requests a fresh invoice, restarting the cycle. As a small company, you don't hold much power over larger enterprises and are forced to comply. By this time, you have submitted GST on the invoice twice, choking your finances further without receiving any money. What can be done to plug this loophole? 2. Credit Guarantee Scheme: While the government's credit guarantee scheme is good, it’s difficult for service companies to actually avail of it. Private sector banks do not encourage such loans as they see little benefit; you have to go through intermediaries who charge 1-2% commissions, adding to interest rates. After months of struggle, you are forced to drop the application or pay commissions. Can this process be made simpler or more transparent? 3. Government Penalties: If your customer payments are delayed, you are forced to delay your own payments, including mandatory payments to government agencies. With the right intent, you make the payment along with late fees and interest. If that’s not enough, you may receive a government notice years later, stating it’s a criminal offense to pay late, and you, as a person of interest, can be prosecuted. This is despite having made the payment along with interest. This appears to be a forced attempt to seek a bribe by government officials. Your alternatives are to go for compounding (paying even more than the interest already paid) or bribing the official (30-40% of the compounding amount seems standard). These officials know that money is important for MSMEs and that they don't have the muscle or time to fight in courts, hence bribes become the only option MSMEs have to exercise. I'm curious to know if others have faced this and what choice they exercised? Despite all this, our #acche #din continues, and we continue to waste time and money on unnecessary issues that could be better spent on growing our business and creating employment.
