CONVEYANCING TIP OF THE WEEK It often happens that immovable property maybe have been registered in the name of both spouses who have subsequently divorced. In an uncontested divorce, the parties will conclude a settlement agreement whereby the proprietary consequences of the marriage are dealt with.  Transfer pursuant to a divorce order is effected in terms of Section 45 of the Deeds Registries Act. If there is a bond on the immovable property, the bond will also be endorsed to reflect the substitution of the debtor under the bond.  No transfer duty is payable on the transaction. Disrepair claims - I act for both landlords and tenants on these cases. It’s so important that if you draft pleadings (and use a precedent) at least amend it properly. I see so many disrepair POCs just pleaded without proper thought to the case. If you fail to plead requisite points such as notice and disrepair you run the risk of strike out and costs of applications to amend the pleadings. I have dealt with two defences in the last week for landlords one fails to plead any disrepair and the other that fails to plead notice.

A recent Supreme Court judgement has brought to light the issue of some law firms taking shortfall deductions from client damages. But what is shortfall and why doesn’t CFG take it? When someone makes a claim, their legal fees are mostly covered by the defendant but sometimes, only a proportion of these costs are recovered. The difference between what your solicitor charges and what the defendant pays is called the ‘shortfall’. In cases where solicitors work on a ‘No Win, No Fee’ basis, not all of the claimant’s legal fees may be covered by the other side. Some law firms take this shortfall from their client’s damages, which means the injured person has less compensation left for their recovery and support. It’s why understanding shortfall is so important – it can impact the actual amount left to cover the injured person’s needs.

CONVEYANCING TIP OF THE WEEK If an agreement of sale is subject to a suspensive condition, then the Seller may insist on a continuous marketing clause to be also inserted into the agreement. This is also referred to as a “72” hour clause. This simply means that the Seller is entitled to continue marketing the property during the suspensive period.  If the Seller, during the suspensive period, receives another unconditional bona fide offer, then he or she is entitled to call upon the Purchaser to comply within 72 hours with all the suspensive conditions. The notice to comply must be served at the Purchaser’s chosen domicilium.  The Seller however cannot demand that the Purchaser to pay a higher price, if the unconditional offer encompasses a higher price. The purpose of this clause is therefore to protect the Seller from missing out on a potential sale. CONVEYANCING TIP OF THE WEEK It is sometimes necessary for reasons of practicality for someone to entrust the management of their affairs to another person. This is normally done by way of a Power of Attorney. A Power of Attorney is a legal document in terms of which the principal, who has contractual capacity, appoints another to act on his or her behalf.  The Power of Attorney will set out the agent’s powers to act on behalf of the principal. It can either be general or specific in nature. The principal can at any time cancel the power of attorney.  It will lapse automatically if the principal dies, is sequestrated or becomes mentally incapacitated.
