Out today on EDRM's JD Supra Channel, award-winning author Michael Berman shares "How Not to Negotiate an ESI Protocol? Say it is āMandatoryā; and, Demand That Discussions be Recorded" šØ ESI Protocol Pitfalls: A Case Study in What Not to Do šØ In Wilbert v. Pyramid Healthcare, Inc., the court delivered a clear message: cooperation in discovery isnāt optionalāand neither is professionalism. As highlighted by Michael Berman in his latest article this decision offers a cautionary tale for litigators navigating ESI protocols: š¹ Recording Rule 26(f) Conferences? Improperāat least without court approval. The court rejected plaintiffās unilateral demand to record the meet and confer, calling it unjustified and obstructive. š¹ āMandatoryā Discovery Plans? A non-starter. The plaintiffās 30-page ESI protocolālabeled as mandatoryāwas seen as an attempt to impose unilateral terms, contravening both the spirit and letter of the Federal Rules. š¹ Proportionality Matters. A sweeping list of search terms (including vulgar and irrelevant ones), broad custodial requests, and a rigid stance on ESI tools ran afoul of Rule 26ās proportionality requirement. The result? The court issued a show-cause order for potential sanctions against plaintiffās counsel and strongly criticized the tactics as uncooperative and burdensome. š” Key takeaway from Berman: Effective discovery begins with dialogue, not demands.
