Say it is “Mandatory”; and, Demand That Discussions be Recorded" 🚨 ESI Protocol Pitfalls: A Case Study in What Not to Do 🚨 In Wilbert v. Pyramid Healthcare, Inc., the court delivered a clear message: cooperation in discovery isn’t optional—and neither is professionalism. As highlighted by Michael Berman in his latest article this decision offers a cautionary tale for litigators navigating ESI protocols: 🔹 Recording Rule 26(f) Conferences? Improper—at least without court approval. The court rejected plaintiff’s unilateral demand to record the meet and confer, calling it unjustified and obstructive. 🔹 “Mandatory” Discovery Plans? A non-starter. The plaintiff’s 30-page ESI protocol—labeled as mandatory—was seen as an attempt to impose unilateral terms, contravening both the spirit and letter of the Federal Rules. 🔹 Proportionality Matters. A sweeping list of search terms (including vulgar and irrelevant ones), broad custodial requests, and a rigid stance on ESI tools ran afoul of Rule 26’s proportionality requirement. The result? The court issued a show-cause order for potential sanctions against plaintiff’s counsel and strongly criticized the tactics as uncooperative and burdensome. 💡 Key takeaway from Berman: Effective discovery begins with dialogue, not demands.
