Harvey Reiter authored a recent Law360 article examining the Trump administration's efforts to expand executive authority over independent federal administrative agencies. Harvey analyzes how the DOJ's planned challenges to a 1935 #SCOTUS decision in Humphrey's Executor v. U.S., if successful, could undermine nearly century-old for-cause removal protections, shifting power toward the presidency. He notes that if the #DOJ's position that for-cause protections are unconstitutional is upheld, it will not only result in agency instability but give the president a de facto ability to shut down the operations of disfavored agencies by stripping them of working quorums.
