Thanks Nicole Gill and Cozen O'Connor and Reuters for this great analysis of where we are in the uses of #genai in #ediscovery. This article poses the core questions we are all being asked, including at Everlaw, about what needs to be disclosed, particularly if Gen AI is going to be used to reduce the set of documents subject to human review. At the very least, I think that Gen AI users in ediscovery should be prepared to disclose how they are maintaining security and client confidentiality and privacy for the content of both incoming and outgoing productions. Personally, I think that when it comes to how a set of data is reduced prior to review, the same concepts of QC and sampling should apply as we do (or should) with respect to the uses of search terms, predictive coding, clustering, or any other non-review means of bulk reduction. We need the same ways to make sure that we take reasonable steps not to leave responsive materials behind. I don't think that opposing parties should be getting into the weeds of each others prompts or searches (attorney work product!) so long as the sampling and QC is reasonably complete. https://lnkd.in/g8bxsuXn

Two uses of generative #AI offer great promise to the #ediscovery industry. Each approach leverages AI differently to analyze data. Let's look at these two different uses and compare their applications, benefits, and limitation.

I'm reaching out today because your clients may have had their sensitive data compromised by BetterHelp, an online therapy provider. This organization has been ordered to pay $7.8 million by the U.S. Federal Trade Commission (FTC) over the alleged release of sensitive user data to social media companies like Meta (Facebook) and Snapchat, Criteo, and Pinterest.     BetterHelp collected data from its app users and visitors of its websites, even from people who had not signed up for a counseling session. The information collected included: Email addresses, IP addresses, and answers from a preliminary health questionnaire during the signup process.      QUICK POINTS   • Customers’ sensitive health data was shared without their consent.  • The information shared was used to identify similar consumers.   • The breach impacted over 800,000 consumers.  WHAT THIS MEANS FOR YOU     This is once again a reminder to consistently vet and monitor all of your vendors. Your company and clients rely on vendors to uphold their promises to protect your sensitive data. In the case of the BetterHelp breach, they shared customer’s sensitive health data without their consent. The breach compromised their privacy and trust. Every vendor has a different policy around privacy and information sharing, so you need to determine which vendors are trustworthy before it’s too late. Litigation teams are at a fork in the road, and the path they take could define what the next several years look like for them. Recover costs on ediscovery to level up their litigation tools, or stay on low cost solutions to absorb as many costs as possible. For the lit support teams and paralegals who want to level up but are having trouble getting attention, here’s a few tips that I’ve seen work well: 1️⃣ Find an eager attorney who wants to test new tools, and invite them to check it out with you (even better if you can find a couple of them). 2️⃣ Gently remind your attorney of a trainwreck litigation case, and tell them you’ve got an idea for how to avoid the same issues next time (might not work the 1st time but by the 2nd time you’re probably opening up the opportunity to “consult”) 3️⃣ Wait for a net new customer to come in, and tell your attorney you’ve got an idea that could work really well for them (most attorneys are resistant to testing something new with legacy clients) Any other ones I’m missing here??
