To “cross the chasm” from Early Adopters to Early Majority in the Health Tech adoption lifecycle, startups must often survive long enough to benefit from unpredictable events (e.g. new reimbursement, public health crisis). Don’t believe me? Let’s look at 4 major examples: 1️⃣ EHRs Epic, Cerner and MEDITECH were all founded before 1980, but just 30 years later in 2008, only ~10% of hospitals had adopted EHRs. It wasn’t until the HITECH Act was passed in 2009 to create financial incentives for adopting EHRs that the category “crossed the chasm”. In 2019, just 10 years later, hospital adoption of EHRs skyrocketed to 80-90%. 2️⃣ Telemedicine Telemedicine was invented in 1959 at the University of Nebraska and billing codes for telemedicine first became available in the 1990s. After decades of slow, steady growth, still in 2019 only 15% of providers were using telemedicine. Just one year later, due to the pandemic, telemedicine adoption soared to 90%. 3️⃣ Digital care journeys This one is very personal to me and SeamlessMD for digitizing patient care journeys with automated reminders, education and symptom monitoring (e.g. pre/post surgery, oncology, pregnancy, chronic care, etc.). We started in 2012 and for many years we were doing most of our business in the U.S. and very little work in Ontario. Even though we had developed tons of clinical evidence, there were just no financial or quality incentives for hospitals to adopt our solution in Ontario for a long time. In 2019, after seven years, still less than 10% of 300+ bed hospitals in Ontario had adopted SeamlessMD. Then in 2020, the pandemic changed everything, as the government started providing funding to hospitals to adopt tech for digital care and remote monitoring to safely discharge patients sooner and cut the surgery backlog. By 2023, almost 70% of 300+ bed hospitals in the province were using SeamlessMD. 4️⃣ AI medical scribes Many folks might think AI medical scribes came into being after ChatGPT was announced to the world in 2022. But actually today’s market leaders like Nuance DAX, Abridge, DeepScribe, Nabla, Suki, Heidi Health, etc. were all founded between 2017-2020. Yet adoption of AI medical scribes only started taking off in 2023… AFTER the ChatGPT moment brought Generative AI into global awareness. In all of these examples, you find that proven benefits and clinical evidence often isn’t enough to drive mass adoption. The friction created by the status quo and misaligned incentives make it a very steep hill to climb. You need a public health crisis, government incentives or some other unpredictable event to “cross the chasm”. I’m not saying Health Tech startups should depend on an unpredictable black swan event to be successful. But what I am saying is that sometimes the best thing you can do to win is just be resilient and survive. It's wild to think in 2024 we're FIRST seeing the DOJ accuse telemedicine conglomerates of criminal drug distribution. How long have we known about these practices in brick and mortar care...? Answer: decades! Take it from someone who prescribed stimulants and other psychotropics to kids over the years - painstakingly measuring and documenting the need and impact - these appalling abuses by Done and Cerebral mean we need more calls for thoughtful pause when it comes to working with startups. Particularly about funding's role - my favorite topic! 🤑 How did we end up with venture capital and PE financing in healthcare that risk the safety of kids in the name of exorbitant returns? Not that all VC or PE dollars are bad, of course, but they're certainly key drivers who shouldn't be in that seat. Did we underestimate these funders as 'barbarians at the gate', much like the pharma reps of the 90's and early 2000's heyday? Have we not learned from Purdue Pharma's aggressive and deadly Oxoycontin marketing? Purdue pleaded guilty to criminal charges and paid $600 million in fines in 2007. Or TAP Pharmaceutical Products's Lupron kickback scheme for the prostate cancer drug? TAP also pleaded guilty to criminal charges and paid $875 million in fines in 2001. Or Pfizer marketing Neurontin, an anti-seizure drug, for off-label uses, such as treating pain and bipolar disorder, even though the drug was not approved for these purposes, and paying physicians kickbacks. In 2004, Pfizer pleaded guilty to criminal charges and paid $430 million in fines. Cerebral and Done's playbooks were practically the same thing, just with a modern mid-pandemic, low-regulatory scrutiny, digital-platform twist. Will appropriate regulation ever outpace American venture greed? Is it even possible to ensure patient safety AHEAD of tragedies driven by the intersection of innovation and venture funding? Walmart joins so many others in quickly entering and leaving or scaling back in healthcare after ambitious plans to scale. This morning, Walmart said it will close all 51 of its health-care clinics, as well as shut down their telehealth virtual care services. This is right after an announcement in March that they wanted to double the size of their clinical operations by opening up over 20 more locations this year and more next year. The reasons they cited? “Like others, the challenging reimbursement environment and escalating operating costs create a lack of profitability that make the care business unsustainable for us at this time.” As a physician, it’s been fascinating to watch over the past few years as so many non-medical companies try to get their bite of the huge percentage of the GDP that is healthcare. They pour money into trying to deliver healthcare at scale, ignoring the many concerns that hospital systems and physician private practices have been citing for years: declining reimbursements, shortages of clinicians, and expensive labor costs. Healthcare is broken, and those that are in it understand why. Patients need - and deserve - quality health care. This requires safe staffing practices, skilled clinicians who can feel good about what they do, and insurance companies that pay their bills. We can’t have a system where insurance companies can get away with record profits while finding more and more reasons not to pay for care and eroding away at the heart of healthcare. You cannot scale your way out of America’s healthcare problem. You actually need to fix the incentives, regulate insurance companies, pay clinicians appropriately, prioritize clinician well being and retention, and focus on the patient. The days of paying lip service to physicians leaving medicine and physician burnout are numbered. Supply and demand forces will necessitate real solutions that move the needle. Companies will come and go in the healthcare space when they realize how hard it is on the ground in healthcare these days. The question for patients and legislators is, who will be left to pick up the pieces if there’s no support for physicians, other healthcare workers, and hospital systems?  The percentage of clinicians leaving healthcare annually because they no longer recognize the heart of why they joined the profession is astounding, with over 1/4 of clinicians looking to leave within the next few years. Physicians face a looming pay cut again next year as CMS proposes to cut the conversion factor for the 5th straight year in 2025! But there's a potential silver lining for ACO participants. CMS is proposing a new advance payment system to reward high-performing providers. This could transform how providers, especially safety-net providers invest in clinical care. And all of this occurs in a background of increasing frustration on the part of lawmakers with the dismal results of the experiments emerging from the Center for Medicare and Medicaid Innovation (CMMI). Congress also has grown intolerant of years of annual Medicare cuts for professional services. This has prompted consideration of a wider-scale overhaul to reimbursement under the program for US seniors. How do you think this advance payment approach will impact providers? Radiologists are achieving payments 500% above the Qualified Payment Amount (QPA) in surprise billing disputes, thanks to the No Surprises Act. This figure is staggering and highlights an important reality: many providers might not realize the tremendous potential of this opportunity. When the No Surprises Act (NSA) was enacted in 2022, the rates at which providers were reimbursed took a major hit, often cut in half. Payors exploited the QPA to justify lower payments, essentially giving themselves the green light to underpay claims. If a provider disagreed with the payment, they had to navigate the cumbersome claims process to recover what they deserved. But here’s the good news: By participating in the IDR process, radiologists are claiming up to 5 times their initial payments. This result is a powerful incentive for payers to engage in a meaningful negotiation and ensure fair compensation. Providers should leverage the NSA to their advantage - and capture every dollar they’re owed.

Dr. Jeffrey Funk Christopher Birkinbine adding to your points, the reason for this hype is that these developers think of healthcare like aeronautics or aviation, whereby all the laws of physics apply, and it is much easier to automate everything. Well, news flash: caring for a human being follows many laws of physics, biology, and emotional and social laws, add healthcare access and discrimination that are all intertwined and sometimes contradictory from person to person. So, while a chat GPT prompt will save patient A, the same prompt output will send patient B to an early grave, yet they have the same health issue. Some folks with Asthma get an attack when they are exposed to pollen or dust, while I also have a patient who can sleep in a dusty storm in the Sahara desert without problems; however, she gets a severe asthma attack only whenever she is upset with her boyfriend. Any time she comes into the clinic for Asthma, I immediately know it; she is going through an emotional exertion like a breakup. A GPT prompt will recommend regular Asthma treatment for both patients, while I will recommend that plus psychotherapy if she needs it. Otherwise, the Asthma will linger in her, while GPT will be a savior in the other patients with typical Asthma. It is the same disease but with different path. THis is just one of the simplest examples I can come up with on the fly.

Current FDA regulations, designed for specific drugs and devices, fall short when applied to AI models with vast and evolving capabilities. A novel approach is needed — one that treats these AI systems more like human clinicians, requiring rigorous training, supervision, and periodic reassessment. While challenges such as AI "hallucinations" and transparency in training data remain, a thoughtful regulatory framework can ensure these technologies safely enhance clinical practice. I was recently invited to deliver three keynotes during the 82nd International Pharmaceutical Federation (FIP) World Congress of Pharmacy and Pharmaceutical Sciences 2024 in Cape Town, South Africa from 1-4 September. During these sessions, I emphasized that we need a completely new approach and framework to regulate AI in healthcare — fully aligned with these insights. As the discourse shifts from models to compound AI systems / agents, we need better AI benchmarks to evaluate multi-modal and multi-step task performance, especially in healthcare and life sciences. When we wrote the first paper demonstrating ChatGPT's performance on the USMLE, we chose the US Medical Licensing Exam as a benchmark for accessibility, speed, and ease. This benchmark was never intended to represent AI model performance on real-world clinical tasks. Today, I still see so many research teams and startups using benchmarks (like the USMLE) that are ill-fitted for assessing the true clinical or scientific performance and utility of the models they are developing for real-world contexts. Benchmark development may be seen as a "less sexy" area of research, but it is of paramount importance. Years after the rise of the transformer, we still lack adequate benchmarks for so many single-step tasks in biomedicine. With compound AI systems (i.e., architectures that integrate multiple AI models to perform complex tasks) emerging, we need new benchmarks for agentic behaviors. I'd argue that developing an agent with novel capabilities without at least proposing a companion benchmark (if an industry standard does not yet exist) may hinder the adoption of said agent, especially for high-stakes workflows. Designing more benchmarks that capture/simulate real-world clinical and scientific workflows will help us mitigate the major discrepancies observed between in silico and in vivo performance and better support safe + effective deployment of AI in biomedicine. As Epic Systems faces a new challenge in the healthcare EHR market, Particle Health has filed a lawsuit accusing the industry giant of unlawfully restricting access to U.S. medical records. The lawsuit, lodged in the U.S. District Court for the Southern District of New York, alleges Epic of anticompetitive practices. Particle Health claims that Epic is leveraging its market dominance to hinder competition and constrain the flow of patient data. Key points from the lawsuit include: - Particle Health filed a lawsuit against Epic Systems on Sept. 23, accusing the company of intentionally impeding its competitor's platform in violation of U.S. antitrust laws. - The lawsuit alleges that Epic is directing clients away from Particle Health's "payer" software, designed to enable health plans to retrieve and leverage medical records stored within Epic's system. - Particle Health argues that Epic asserts control over health data for up to 94% of the U.S. population. Epic Systems has refuted the claims made by Particle Health, dismissing the lawsuit as groundless. Stay informed as this legal battle unfolds in the healthcare tech industry.

I get Dr. Yang's concern about large, wealthier health systems adopting AI sooner than smaller, poorer organizations, but this is actually a good thing...unless your time horizon is myopically short. Big organizations, with much larger budgets and sophisticated IT teams, can afford to take risks, make mistakes, and test out exciting (but still unproven) emerging tech while smaller organizations certainly can't (for the most part).
