Exciting start to #CGI2024 with inspiring speeches from Jenn McCarron of CLOC (Corporate Legal Operations Consortium) and Cassandra Worthy of Change Enthusiasm Global talking about the future of legal ops and effective change management. Jenn spoke about the importance for legal ops professionals to think ambitiously in her speech laced with space-exploration metaphors: "We need to change how we see our role. We’ve always thought of ourselves as problem solvers. That’s no longer enough. Understand that the technology and the data are the engines and the fuel of this rocket ship. They are not the destination. The point is to turn them into narratives and answers that show us and our companies the way forward," she said. "We have to engage across the entire company to create impact. To help connect the pieces together into something new that works." Cassandra emphasized the importance of thinking about the emotional side of implementing change in organizations. That means acknowledging and working through the fear, anxiety and other negative emotions that change can generate in ourselves and others to effect positive change. "The emotions of change carry the power to significantly impact the change you are trying to achieve. We believe that it’s at the intersection of change and emotion that our growth potential is determined." A theme of reasonableness underlies the opinion; competence, for example, does not require GAI expertness, but a ‘reasonable understanding’ of the technology’s capabilities and limitations, which cannot remain ‘static.’ How much ‘independent verification or review’ will depend on the circumstances of the task. When the ABA first discussed adding a technological component to the competence rule, concern was raised as to the cost to the smaller firms or solo practitioners. From my latest for Privacy Daily: The second U.S. state privacy law could be updated this year. Virginia’s legislative session opened Wednesday with a bill by Del. Michelle Maldonado (D) that would add protections for teens, include support for universal opt-out mechanisms and revise other parts of the 2021 Virginia Consumer Data Protection Act. Maldonado's measure would also add an AI section called the "Artificial Intelligence Training Data Transparency Act,” which includes a private right of action. https://lnkd.in/edEN9ria #privacy #ai

A very important part of press freedom, and our First Amendment rights is a robust court. “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.” A really smart person told me that last line was probably the most important terminology and most over looked part of the document. To petition for redress of grievances is important in all categories of law. Journalism is the watch dog, and law is its armor. Journalism often depends on a robust court system to gain access to vital information the public needs to know about. The health of courts is so important. We should all be paying close attention to all our elections and how those elections impact judicial systems.

The Department of Justice recently declined to prosecute a biochemical company after the company voluntarily disclosed an employee's violation of U.S. export controls and also showed "exceptional" cooperation with the DOJ's National Security Division. It marked the first such case under the DOJ's new corporate enforcement policy and provides important takeaways for global corporations operating across borders with myriad operations and supply chains. The @law360union is still on an unfair labor practices strike, because @law360_news management has so far dithered on coming back to the bargaining table after we offered significant concessions. We haven't heard from them since Tuesday, which means we're still on the picket lines, wherever we may find them. Because I'm a writer, and a diligent professional, I found my line writing up a piece of news that Law360 is missing right now, because it doesn't have the people or their expertise. Law360 also doesn't have something I usually don't offer in a professional capacity; entirely too much snark.
