𝗪𝗵𝘆 𝗛𝗲𝗮𝗱𝗶𝗻𝗴𝘀 𝗠𝗮𝘁𝘁𝗲𝗿 𝗶𝗻 𝗔𝗽𝗽𝗲𝗹𝗹𝗮𝘁𝗲 𝗕𝗿𝗶𝗲𝗳𝘀 Under California appellate rules, briefs must state each point under a separate heading or subheading.  Appellants and respondents alike should heed this requirement, as both persuasion and preservation may depend on it.  Some practice tips to consider: ✅ Many appellate courts will deem an argument forfeited if buried under an unrelated heading, or made only in a footnote. ✅ Headings should be substantive, but not so lengthy that they cease to serve as "headlines" and start to resemble text. ✅ Organizing headings for each distinct contention brings discipline to the drafting process, making the brief more coherent and digestible.  Generating a new Table of Contents for each draft is an excellent editing tool, helping you see whether points flow logically and persuasively. ✅ If the Table of Contents has "gaps" that would confuse a stranger, revise.  Justices often read the TOC to gain a substantive overview of the brief before diving in.   ► 𝗧𝗵𝗲 𝗽𝗿𝗮𝗰𝘁𝗶𝗰𝗮𝗹 𝗺𝗲𝘀𝘀𝗮𝗴𝗲:  Ensure that your brief headings are crisp and clear, and that they smoothly outline all your core contentions on appeal. #appeals Laurie Hepler

VPLC is excited to share some news with you firsthand: the launch of our groundbreaking Eviction Defense Center and the kickoff of our 24-hour Justice Day campaign tomorrow. Low-income Virginians facing evictions will soon have more resources to help them navigate the court system using the new and innovative Eviction Defense Center (EDC). This easy-to-use online tool is the first initiative to launch as part of Virginia Poverty Law Center’s planned self-help resource platform. The Eviction Defense Center is designed to bridge the state’s justice gap by offering essential information to people who may not have access to a legal aid attorney. The site can be found at FightMyEviction.org, or at NoDesalojo.org for resources in Spanish. Both open on Justice Day, May 1st, as VPLC conducts a 24-hour giving campaign to raise money for self-help resources. “Going to court is an intimidating and often confusing process, and people without an attorney rarely get good outcomes,” says EDC Director Phil Storey. “Now renters will be able to better understand their rights and prepare for court.” Each day, more than 400 evictions are filed in Virginia, where there are over a million renting households. To participate in the fundraising campaign to create more of these free self-advocacy resources, visit vplc.org for Justice Day information. Future tools cover consumer rights, access to health care, utilities, public benefits, and legal resources for seniors. 🌟 Exploring Nonlawyer Providers to Enhance Access to Justice in DC 🌟 The DC Courts are considering proposals to allow trained nonlawyers to provide legal assistance for residents facing civil legal challenges, aligning with similar efforts in states. 🔍 Why This Matters: Access to Justice Gap: A staggering 75-97% of individuals in certain civil cases in DC do not have legal representation, often due to cost barriers and limited resources. Innovative Approaches: The DC Civil Legal Regulatory Reform Task Force is exploring proposals to use trained nonlawyers—like licensed paraprofessionals and community justice workers—to address urgent legal needs in housing, family law, and public benefits. Broader Landscape: Similar initiatives are underway in other states, including Texas, to enhance access to justice for underserved communities and improve overall court efficiency. 🗣️ Get Involved: The DC Task Force is seeking input through: Surveys: Online surveys for legal and social service professionals and community members are open until October 11. A well-functioning federal judiciary requires sufficient funding to operate efficiently and securely. LCJ is urging Congress to fully fund the federal judiciary’s FY 2025 budget request, including critical initiatives for IT modernization and cybersecurity; court security; and federal employee pay increases necessary to attract and retain top talent. LCJ’s letter to the congressional appropriations committees supports the budget request because a well-functioning court system is important to public trust in our courts.
