How did a close-call bill almost dismantle Florida's thriving hemp industry? Here's the inside scoop 👇 Last Friday afternoon, Florida's hemp industry breathed a collective sigh of relief. The hero of the hour? Governor DeSantis, who shielded the industry from a potential setback by vetoing SB 1698. The supporters of SB 1698 had certain compelling arguments, claiming the bill aimed to protect children. However, it's becoming evident that the bill's real goal was to undermine and abolish our current local hemp economy. Isn't it odd that market competitors often have the solution to a problem that doesn't exist? Governor DeSantis saw through the facade, opting to shield small businesses from unnecessary regulatory burdens. In his veto letter, he insightfully commented that the bill, though based on commendable goals, would likely do more harm than good. The Governor highlighted the importance of striking a delicate balance. He had signed a bill just the previous year to elevate consumer safety in the hemp market without compromising jobs, consumer choice, or the availability of end-use markets for farming individuals. Citing the example of SB 1676, which restricts the sale of certain hemp products and promotes industry-wide compliance with food and safety standards, he stressed the support of the hemp industry toward rational and balanced approaches. This is the kind of balance the hemp industry has been advocating for across the country and at the Indiana General Assembly for years. But he didn’t stop there! In an inspiring move, he pushed for a collaborative approach. He urged the Florida General Assembly to engage with stakeholders and devise improved quality standards and protections for consumers. Governor DeSantis also used his influence to push the Florida Department of Agriculture and Consumer Services to exercise its authority to weed out products that defy Florida laws. After all, what good are laws and regulations if there's no force behind them? Kudos to Governor DeSantis and the Florida hemp industry for taking brave measures to protect local farms and consumers' choice in the wellness market. 👏 So I leave you with this question: How important is it for government authorities to play a proactive role in nurturing and defending local industries? 🚀 Highlights from the August 6, 2024, NYS Cannabis Control Board Meeting Here are the top takeaways from the latest meeting of the NYS Cannabis Control Board: 1. Retail Applicants Approved: -86 New Adult-Use Licenses: Including 22 retail dispensaries, 16 microbusinesses, 19 cultivators, 11 distributors, and 18 processors. -See the attached chart to review progress in the November Queue. 2. Changes to Allowances for Public Convenience: -The Board proposed new regulations for waiving the distance requirements between dispensaries in the name of public convenience. -The following will be considered: 1. The number, classes, and character of other licenses in proximity 2. If all necessary licenses and permits have been obtained  3. Whether there is a demonstrated need for such a license 4. The effect on pedestrian or vehicular traffic and parking 5. Noise levels 6. A history of cannabis violations and reported criminal activity  7. Any other factors specified by law or regulation 3. Clarification on Deficiency Responses: -It was mentioned that deficiencies must be responded to within 30 days, when previously it was emphasized that they needed to be resolved in that time. This distinction gives applicants more peace of mind when dealing with difficulties related to OCM technology. 4. Agenda Adjustments: -Aligned with decisions made in their previous meeting, the Board removed denials from the agenda at the last minute, focusing instead on moving forward with the application process and support for successful candidates. Licensing Update: -The state now boasts 156 licensed dispensaries with June retail sales reaching $71 million. Total sales since the program's launch are approaching half a billion dollars. -Nearly all conditional cultivators and processors have applied for full licenses, and the majority have been approved, with the expectation of closing out these applications in the next 2 meetings to focus on December supply side licenses. As the New York cannabis market continues to grow, these updates reflect our ongoing journey towards a regulated, equitable, and dynamic industry. As the cannabis industry matures, we are starting to get reliable data. This can help make decisions based on real sales figures and not predictions. 10 years ago, there was only one state with adult use sales (#colorado) and a handful of states with medical seals. Now there is 24 sates with adult use sales and an additional 15 states with medical seals. At the moment #california leads with total seals but #michigan leads with per capita seals. #florida leads in medical seals. #missouri with a relatively small population and only 17 months since they launched their adult-use market, is already in fifth place. 📢 Quick update from the latest NY Cannabis Control Board (CCB) meeting: Big milestones reached—over 1,100 adult-use licenses issued this year and the opening of New York's 200th dispensary! 🌱 The market is expanding fast. Currently, there are more licenses than active proximity protections, and we anticipate updates to some proximity protections by Oct 23rd. We’ll be looking into this and reporting back soon. Also, provisional licensees do not need to return to the board for final approval, meaning there may be fewer provisional licenses and more active retail operations than shown in the table. #NYCannabis #CannabisRegulations #MarketGrowth
