NY General Obligations Law 5-1401 has achieved legendary status in choice-of-law circles. It requires NY courts to enforce NY choice-of-law clauses in high-dollar-value commercial contracts. In today's post, John Coyle argues that while the statute serves a useful purpose, it can undermine the ability of other sovereigns to apply their own law to persons and events within their borders. On June 24, 2024, the Chinese Supreme People's Court officially issued the Judicial Interpretation of Antitrust Civil Litigation (the “New SPC Interpretation”). The SPC Interpretation represents a significant move from both procedural and substantive perspectives in antitrust civil litigation as it comprehensively revises and refines the rules for the first time since the last interpretation was issued in 2012. Interesting- Cornell Law raising their cap on full federal loan repayments for its law graduates in public interest jobs earning up to $120,000 annually- up from $80,000. I more of a believer in lowering tuition from these absurd levels, but I suppose this will put a little bigger band-aid on that problem. Yi argues that such policies conflict with the Fair Labor Standards Act (FLSA) and undermine the health, safety, and education of minors. Drawing on evidence of increased child labor violations and injuries around the country, Yi advocates for stronger federal enforcement and stresses that addressing labor shortages shouldn’t come at the expense of children’s rights and welfare. 🚨 NJ Appellate Division Decision – Jurisdictional Law on Sex Abuse Litigation 🚨 On February 28, 2024, the NJ Appellate Division decided E.T., A.M., A.R., and others v. The Boys and Girls Clubs of America, reversing the lower court's decision that New Jersey courts have specific personal jurisdiction over the Boys and Girls Clubs of America (BGCA) in a case involving allegations of sexual abuse by a counselor within The Boys and Girls Clubs of Hudson County. This pivotal decision highlights the complexities of jurisdictional law, particularly in cases involving national organizations with local affiliates.   In this case, the plaintiffs alleged they were sexually abused by Arthur Freudenberg, a part-time counselor for the Hudson County BGC, between approximately 1978 and 1982. They sought compensatory and punitive damages from the local entity and the national organization, BGCA. However, jurisdictional discovery showed that BGCA, based in Georgia, did not have direct control over the local club's hiring, training, or supervision practices, including those of Freudenberg. There are exceptions that prove every rule, but: If the goal is to work in the U.S. after the LL.M. in a relatively well-paying legal job, I generally recommend at least 2-3 years of substantive, post-licensing work experience before studying in an LL.M. program. I'd personally suggest 3-5, but that's flexible based on what and where you're studying (hooray, top Tax LL.M. programs!), your own connections, how well you're able to hustle/network, and some other soft factors.
