🚨 **Addressing Drainage and Infrastructure Needs in Kenner and the East Bank Post-Hurricane Francine** 🚨 Today, Byron Lee, Jefferson Parish Councilman District 3 and I introduced two joint resolutions aimed at tackling the urgent drainage and infrastructure challenges in Kenner and across the East Bank of Jefferson Parish in the aftermath of Hurricane Francine. Our goal is to ensure that our communities are better protected and prepared for future storms. 🌧️🌪️ **Key Points from the Resolutions:** 1️⃣ **Improving Kenner's Drainage System:** We’re requesting the Jefferson Parish Administration to take immediate action on multiple fronts, including: - Investigating funding opportunities through the Southeast Louisiana Urban Flood Control Program (SELA), the Louisiana Watershed Initiative, and FEMA's Flood Mitigation Assistance Program to enhance Kenner's drainage capacity. - Prioritizing the construction of new pump stations in Kenner, such as the Woodlake Estates-Seton Parc and South Kenner Pump to the River projects, to ensure the city has the necessary infrastructure to handle future flooding. 2️⃣ **Ensuring Effective Airport Drainage:** We are also calling on the Jefferson Parish Attorney’s Office to work with the New Orleans Aviation Board to secure vital information on the drainage pump facilities serving the Louis Armstrong New Orleans International Airport (MSY). This includes: - Requesting maintenance, inspection, and testing logs to ensure the pump station is functioning correctly and efficiently. - Reviewing the Standard Operating Procedures (SOPs) to identify any potential issues that need addressing, ensuring the airport's drainage system can protect our residents from future flooding. Together, these resolutions aim to strengthen our drainage infrastructure, not only to protect Kenner but also to safeguard the entire East Bank of Jefferson Parish. Tillery (Case No. A24A0699), the Georgia Court of Appeals reinforced the importance of statutory deadlines under the Uniform Voidable Transactions Act (UVTA). The court reversed a superior court ruling in favor of Christopher Tillery, holding that his complaint to void a quitclaim deed was untimely under the applicable four-year statute of limitations. Background This case stemmed from a quitclaim deed executed on August 11, 2018, by Lisa Barnes, transferring her interest in certain real property to Stewart Barnes, Benjamin Barnes, and Kaitlyn Barnes. The deed was recorded two days later, on August 13, 2018. Nearly two years later, on March 17, 2020, the superior court entered judgment against Lisa Barnes in favor of Christopher Tillery based on an arbitration award. On September 22, 2022—more than four years after the transfer—Tillery filed a complaint under OCGA § 18-2-75 (a) of the UVTA, seeking to void the quitclaim deed as a fraudulent transfer. The defendants moved to dismiss the complaint, arguing it was untimely under OCGA § 18-2-79 (2), which requires actions to be brought within four years of the transfer. The superior court denied the motion, concluding that the complaint was timely because it related to obligations arising within four years of the March 17, 2020, judgment. Court of Appeals Decision The Georgia Court of Appeals reversed the superior court, clarifying that the relevant date under OCGA § 18-2-79 (2) is when the transfer was made, not when the obligation arose. In this case, the quitclaim deed was executed and recorded in August 2018, meaning the deadline to file a complaint under the UVTA was August 2022. Since Tillery filed his complaint in September 2022, the claim was barred. The court emphasized that failing to meet statutory deadlines extinguishes the cause of action, leaving no room for equitable exceptions. The ruling serves as a critical reminder that procedural timelines under the UVTA are strictly enforced.
