UnitedHealth Group, Cigna Healthcare, and CVS Health are suing the Federal Trade Commission, claiming its case against their pharmacy benefit managers (PBMs) over alleged insulin price inflation is unconstitutional. The crux of their argument? 𝗧𝗵𝗲 𝗙𝗧𝗖 𝗳𝗶𝗹𝗲𝗱 𝘁𝗵𝗲 𝗹𝗮𝘄𝘀𝘂𝗶𝘁 𝗶𝗻 𝗶𝘁𝘀 𝗮𝗱𝗺𝗶𝗻𝗶𝘀𝘁𝗿𝗮𝘁𝗶𝘃𝗲 𝗰𝗼𝘂𝗿𝘁 𝗿𝗮𝘁𝗵𝗲𝗿 𝘁𝗵𝗮𝗻 𝗳𝗲𝗱𝗲𝗿𝗮𝗹 𝗰𝗼𝘂𝗿𝘁, which the companies argue undermines due process by making the FTC both prosecutor and judge. EVERY C-SUITE EXECUTIVE AT EVERY EMPLOYER NEEDS TO READ THIS. Here is another great article from Wendell Potter, a former Big Health Insurer top executive. Hear it from another top BUCA executive, Terry Shook, who discloses the truth, with the trusted Big Health Insurers it's company before clients. A few of the key points: -       Shook began to question whether his efforts were honest or ethical – worrying about the impact of placing profit ahead of patients, prioritizing company revenue at the expense of employers and health plan members. -       “I had the power to manipulate rates and the marketplace. By and large brokers with the largest books of business received the best interventions.” (Said Shook regarding rates and renewals.) -       Some brokers would actually requested a rate increase at renewal to increase their own income. Shook says this is, “a vicious and perverse cycle that he says continues to this day.” -       In addition to standard compensation, some of the large brokerage houses also add a per-script charge of up to $5 to the pharmacy benefit manager’s fee, which is not disclosed to the employer. -       According to Shook, the Big Health Insurance companies prioritize revenue over their clients’ best interests because they are beholden to Wall Street and their shareholders before employers and plan members. Shook implores brokers and advisers to put their employer clients first and stop their “misplaced and unconscionable allegiance to Big Health Insurance companies.” Shook concludes, “If your advisor program doesn't help achieve full transparency to the cost and quality of your health plan, get a new one.” If your advisor isn’t completely transparent with you, then they're not putting your company first over their own interests.   Your advisors interests have to be aligned with yours, and many forward-thinking advisors that are confident in their solutions will even put part of their compensation at risk behind their recommendations.
