Major Overhaul Coming for Healthcare Cybersecurity in 2025: Compliance Burden to Increase 🚨 Big changes are coming to HIPAA's Security Rule, and healthcare organizations need to prepare. A long-awaited update is set for 2025, bringing stricter cybersecurity requirements that will impact providers, plans, clearinghouses, and their business associates. Key Highlights: 🔐 Stricter Security Standards: The new rules include mandatory patch management, multi-factor authentication (MFA), encryption, risk assessments, and more. 💸 Increased Costs: The White House estimates the new rules will cost healthcare organizations up to $9 billion in the first year alone. Smaller providers may face costs ranging from $100K to millions. ⚖️ Elimination of Flexibility: The updated rule removes the "addressable" provisions, meaning all organizations will have to follow the same stringent requirements—no exceptions based on size or capabilities. 📈 Ransomware Threats: The rise in large-scale healthcare breaches (up 102% since 2018) is driving these updates, with ransomware as a primary concern. These strategic investments in cybersecurity are not only warranted but essential in the face of the growing frequency and severity of cyber threats targeting healthcare data. The emphasis on protecting patient data and healthcare infrastructure is well justified, and the focus on this area clearly responds to the trends that the image depicts. The enhanced commitment to cybersecurity across the healthcare industry is a prudent move to safeguard sensitive personal health information (PHI) and ensure healthcare services' continuity and reliability. The steep rise in healthcare data breaches of 500 or more records from 2019 onwards highlights the critical importance of the reported increases in cybersecurity budgets and team sizes within healthcare organizations. It's evident from the data that cybersecurity has become a more significant concern, with the peak of reported breaches reaching 739 in 2022, compared to only 18 in 2009. 🚨 ALERT: New ACPT Could Reduce MSSP ACO Benchmarks in 2024 🚨 Two key challenges have emerged around the calculation of the Accountable Care Prospective Trend (ACPT), which could impact MSSP ACO Benchmarks in 2024: Inflation - Fee-for-service (FFS) trends seem to have outpaced the baseline trends CMS used to develop the ACPT—by as much as 2-3%. If the ACPT accounts for reduced inflation in the Benchmark while ACO expenditures reflect actual inflation, Shared Savings could be diminished. COVID Impact - Under the PHE, five months of 2023 expenses excluded claims related to COVID diagnoses/events. This exclusion reduces the 2023 denominator in the trend calculation for 2024, potentially inflating the trend. However, CMS did not adjust the baseline USPCC trends, further lowering the Benchmark when weight is applied to the ACPT. CMS’s Guardrail Policies to Address Trend Variations - In its August 2024 ACPT methodology release, CMS introduced two guardrails: A. Recalculating Shared Savings Using the Two-Way Trend - If the Three-Way Trend leads to significant losses, CMS may switch to the Two-Way Trend to calculate ACO responsibilities or savings. B. Reducing Weight Applied to ACPT in Unexpected Scenarios - CMS reserves the right to reduce ACPT weight if actual expenditure growth significantly deviates from initial projections. 💡 However, CMS noted that the need to reduce ACPT weight is unlikely since deviations should also reflect in the Two-Way Trend, making the first guardrail policy more probable.
