HIPAA Privacy Rule
- The Privacy Rule is specific to how entities can use and disclose PHI. This is another rule that is not specific to EPHI or PHI. As long as it falls into one of those categories, you must comply. Entities must take necessary steps to ensure the privacy of others. They also have to make sure their data is not sold or exploited in any way. Now, that is not to say an entity may never disclose or use someone's information. If a person asks to disclose information then the entity may do so, or they may have to in order to make sure a payment is processed. Think about when you go to the doctor and are asked to read their HIPAA form. You may remember seeing a section that asks if they can disclose your information, and if so, to whom.
