Legislation regarding sexual harassment is being strengthened and comes into effect on 26 October 2024. This means that all employers will be expected to put in place reasonable steps to prevent sexual harassment in the workplace. This means having a more systemised approach when dealing with such allegations including initial and ongoing training, robust processes, and procedures, and clear communication regarding acceptable behaviour. As with any legislation - ignorance is no defence! Any claims that go to an Employment Tribunal can be uplifted by 25% - if it was part of a multiple ET claim, this could easily be six figures. New legislation comes into force on 26 October that will require all employers to take ‘reasonable steps’ to prevent sexual harassment in the workplace. If they don’t, they could face a 25% uplift in the compensatory award in a related Employment Tribunal claim.
