How do I handle an employee that is neurodivergent? If you have staff that neurodivergent or you're an employee that is neurodivergent, then you may want to listen to this video. Hi, I'm Tracy and I run HR consultancy called Shore Thorpe. Please follow our page for employment law and HR updates. So what is neurodivergent? People who identify as neurodivergent may have conditions such as ADHD, autism, dyslexia, Tourettes. Various mental health conditions, for example bipolar and OCD. Employees should be aware that a neurodiverse employee is likely to be regarded as disabled under the Equality Act 2010, so look that up. And therefore they're protected against unlawful discrimination, harassment, victimisation on the basis of their condition. The law also places an owners unemployed ears to proactively explore and implement reasonable adjustments for that individual where their condition puts them at a disadvantage of work. There is a significant upward trend in claims at tribunals currently against employers from neurodivergent employees due to the failure to comply with the applicable legal obligations. Employers really need to adopt inclusive workplace policies and consider reasonable adjustments in. Every case of neurodivergence to not only demonstrate commitment to having a diverse, inclusive and supported workforce, but also to minimise the risk of legal claims if a protected employees legal rights are infringed. HR professionals should be creating a supportive workplace for neurodivergent staff by promoting education and acceptance, offering workplace adjustments and flexibility, and focusing on strengths and inclusion. And by doing so, employees can create a positive and productive workplace for all staff. Many newer divergent people change their behaviour or try to hide their differences to fit in and accommodate others around them. This is a common coping mechanism. This is known as masking. So over time however, masking can lead to burnout, stress and and depression. Revolt. Unfortunately, most neurodivergent people do end up masking to a certain extent. But workplaces can help to lessen the toll that this takes by encouraging people to talk openly and honestly about the challenges they face at work, with their manager or even a trusted colleague, and by improving awareness of neurodiversity across the organization.
