Congratulations to the Bureau of Cyberspace and Digital Policy team led by Ambassador Nathaniel Fick, Liesyl Franz, and especially Adam Segal for today's publication of the inaugural United States International Cyberspace & Digital Policy Strategy. I truly appreciate the opportunity to collaborate and inform on the U.S. Chamber of Commerce's international cyber, digital, trusted telecommunication, and emerging technology priorities and the call out for enhanced collaboration with the private sector. The release of the United States’ International Cyberspace and Digital Policy, announced by Secretary of State Antony Blinken at #RSA2024 on May 6, puts forward an affirmative vision to work with allies, partners, and stakeholders to support an open, interoperable, secure, and reliable Internet. This “Digital Solidarity” approach is a critical exercise of the United States’ soft power and affirms the value of global cooperation and mutual assistance. Protection of human rights is fundamental to the U.S. global engagement on digital and cyberspace issues, and this strategy puts those values front and center to U.S. engagement. The Strategy highlights the value of collaboration with public and private partners across the globe, including at the center of disruptive actions to combat cybersecurity threats. This approach underscores the effectiveness of partnerships to enhance responsible state behavior in cyberspace. Prioritizing partnership, including through cyber capacity building efforts, enhances all of our digital security. The Strategy also recognizes the threat that #ransomware poses to the reliability of connected technologies, and highlights the importance of collaborating with other governments to disrupt these criminal gangs. IST is working with the multistakeholder community to make progress towards combating ransomware, including through our efforts to support the International Counter Ransomware Initiative. The U.S. Department of State has published its ‘United States International Cyberspace & Digital Policy Strategy’ that focuses on digital solidarity, which is a willingness to work together on shared goals, stand together, help partners build capacity, and provide mutual support. Collaborating with other federal agencies, the Department of State aims to steer international involvement in #technology diplomacy and align with the National Security Strategy and National Cybersecurity Strategy. To build broad digital solidarity, the strategy lays out three guiding principles and four action areas. “Central to our strategy is the effort to build digital solidarity – working together to offer mutual assistance to the victims of malicious cyber activity and other digital harms; assist partners – especially emerging economies – in deploying safe, secure, resilient, and sustainable technologies to advance their development goals; and builds strong and inclusive innovation economies that can shape our economic and technological future,” Antony J. But what does this mean for the world of Open Source Intelligence (OSINT)? 🔍 Implications for OSINT: Enhanced Data Access: As nations build more robust digital infrastructures and share resources, OSINT professionals might find a wealth of new data sources. 🔎 Advanced Analytical Tools: Expect cutting-edge tools that leverage international tech cooperation, potentially boosting our analytical capabilities. ⚖ Clearer or Fuzzier Legal Pathways: More harmonized digital laws could make cross-border OSINT operations smoother and less fraught with legal hurdles...or it could become more challenging, depending on who else is in agreeance with our strategy. U.S. Department of State releases International Cyberspace and Digital Policy Strategy... Three guiding principles: 1. An affirmative vision for a secure and inclusive cyberspace grounded in international law, including international human rights law; 2. Integration of cybersecurity, sustainable development, and technological innovation; and 3. A comprehensive policy approach that utilizes the appropriate tools of diplomacy and international statecraft across the entire digital ecosystem; and Four areas of action: 1. Promote, build, and maintain an open, inclusive, secure, and resilient digital ecosystem; 2. Align rights-respecting approaches to digital and data governance with international partners; 3. Advance responsible state behavior in cyberspace, and counter threats to cyberspace and critical infrastructure by building coalitions and engaging partners; and 4. Strengthen and build international partner digital and cyber capacity, including capacity to combat cybercrime. I suspect that we'll see increased efforts to internationally align things like data privacy, rights to your digital information / image / identify, the beginnings of international conventions on cyber-attacks, justified consequences, and liabilities for pursuing cyber disruptions. Protections in those convention will especially focus on the protection of critical infrastructure. Some of this may be very forward facing toward newer technologies, and toward industries reliant on a pivot like sustainability efforts. Meaning, policy efforts and guidance may focus on emerging technologies, industries, and the needs of emerging markets while legacy systems and industries may be left a bit more to their own devices, or at least their grandfathering into this strategy may be a bit looser. Nations view control over data security, cyber infrastructure, and access to digital technologies as essential components of their sovereignty. This shift simultaneously fosters both global collaboration and conflict. Digital sovereignty is closely tied to efforts to limit the influence of major tech corporations. Governments aim to assert control by developing their digital infrastructure and storing data on local servers. However, threats like cyberattacks and digital espionage significantly impact international security. Some argue that competition over digital sovereignty could create a new Cold War dynamic. For instance, China’s “digital wall” and the European Union’s data protection regulations demonstrate contrasting approaches. Yet, nations may still collaborate to establish shared norms.
